The Delaware non-compete agreement is used to prevent a Delaware employee from competing with their employer and from soliciting employees/clients post-employment. It contains terms which define the geographic scope of the agreement, that is to say, the radius in which the employee will be prohibited from working. Most importantly, it contains the amount of time for which the agreement is enforceable. Restrictive covenants are deemed enforceable by Delaware law if the terms of the agreement are reasonable and considered imperative to protect the business interests of the employer.
