The New Mexico subcontractor agreement is a binding agreement regarding the work needed for an ongoing job. The document describes the kind of work or services the subcontractor is expected to provide, the rate at which they will be paid, any expenses, the time by which the work would be done, and the dates they will be paid. Because the subcontractor is a 1099 employee, it is the hiring contractor’s duty to ensure payment.

State Definition (§ 60-13-3(A-B)) – “Subcontractor” means any person performing construction covered by a contract between an owner and a contractor but not having a contract with the owner.
