The Illinois subcontractor agreement is a contractual obligation between both contractor and subcontractor. Typically known as a 1099-employee, the subcontractor is to provide a service or product in order to assist the contractor in fulfilling a service for its client. Once the subcontractor completes their duty, the contractor is to issue payment for the services.

State Definition (720 ILCS 5/33E-2(k)) – “Subcontractor” (1) means any person, other than the prime contractor, who offers to furnish or furnishes any goods or services of any kind under a prime contract or a subcontract entered into in connection with such prime contract; and (2) includes any person who offers to furnish or furnishes goods or services to the prime contractor or a higher tier subcontractor.
