The Wisconsin non-compete & non-solicitation agreement offers employers the ability to safeguard their company interests by preventing employees from engaging in competitive business activity. Additionally, the agreement imposes a prohibition against solicitation in order to avoid the loss of customers, other employees, or company contractors. The restrictions will be imposed for the duration of the individual’s employment and will last for a specified period after the employer-employee relationship expires. The post-employment restrictions, however, will be limited to a geographical range which shall extend no further than what is necessary to prevent competitive business activity.

Laws – § 103.465

Non-Compete Limit – Time and territory restrictions must be reasonable and necessary to protect the employer’s business.

Non-Solicitation Limit – Restrictions are only enforceable if they are necessary for the prevention of unfair business competition against the employer.
