The South Dakota non-compete & non-solicitation agreement allows an employer to restrict an employee’s ability to operate with similar companies or engage in activity which competes with the employer. Additionally, the agreement prevents the employee from soliciting existing employees, clients, customers, or other parties affiliated with the employer’s business. Once the document is signed, the limitations imposed on the employee will remain in effect for the entirety of their employment and up to two (2) years following their termination. The restrictions will be limited to a specific geographical location which can extend no further than a particular county, first or second class municipality, or another designated area.
