The Arkansas Non-Compete Agreement is a document which achieves two functions for an employer; 1) it prevents past employees from working for competitors, and 2) it prevents past employees from stealing (soliciting) clients and current employees. In the State of Arkansas, the laws which govern non-compete agreements state that the reasonableness of the covenant not to compete will be determined by the nature of the business interests in need of protection, the time limitation of the non-compete clause, and the geographical restriction of employment. In other words, reasonableness is determined on a case-by-case basis.
